Golf carts CANNOT be operated on any Town, County or State maintained road in North Carolina unless the driver/operator has a valid driver license, and the vehicle is properly equipped with turn signals; properly working brakes, headlights and taillights; been inspected and sticker attached thereon; and covered with proper financial responsibility/insurance. Golf carts are permitted to cross a roadway to the other side by the most direct route. Children cannot drive any vehicle on a roadway/street unless properly license regardless of age.

No. The same law applies to these types of conveyance/vehicles as does golf carts.

The child can be prosecuted and if found guilty in juvenile court, denied a drivers license privilege until they become 18 years of age. Additionally, if a juvenile is found operating a vehicle in violation of the law, the parents can be charged (given ticket/citation, or arrested) for allowing a child/juvenile to operate a vehicle in violation of NC Laws, and the parents (if found or plead guilty) can receive points against their drivers license and receive insurance points as well.

No. There is nothing in the law books that says a person can drive 5 to 9 miles over the speed and NOT be given a ticket for speeding. There is no fine print on speed limit signs that say "you are allowed to drive 5 to 9 miles over the posted limit and not get a ticket." The posted speed on the speed limit sign is the LIMIT (maximum) you can drive without getting a ticket (providing your speedometer is correct.) Remember: It is your responsibility to have a properly working speedometer on your vehicle. Changing the size tires on your vehicle as well as replacing or repairing the transmission and rear-end can have an impact on a speedometer reading.

Wilgrove-Mint Hill Road Sidewalk Project
|
|
A: This is a design/survey question and would depend on the lay of the land; however, the Town would not seek any more land than is necessary to construct the sidewalk.
|

A: If the sidewalk is the cause of the injury, then I believe the liability, if any, would be with the Town. If the land is deeded in fee simple to the Town of the North Carolina Department of Transportation (NCDOT), then this should be a non-issue because the individual would not actually own the property.
|
|
|
A: Probably the "cleanest" way to structure it is for the property owner to deed the property to either NCDOT or the Town in fee simple. That way the property would have no owner liabilities, e.g., presumably the real estate taxes would be slightly reduced.
|
|
|
A: Yes, but the would need to check with their accountant to determine how the deduction would be handled. The Town will sign a form from the Internal Revenue Service (IRS) denoting a donation was received. The property owner is liable fro determining the amount of the donation.
|
|
|
According to Mecklenburg County, property owners are currently not being assessed for the value of their property which is used as roadway. Also, the Tax Assessors office state the value is based on usable site area and given the amount of donation required to construct the sidewalk there will likely not be a tremendous impact on usable site area. If there is a substantial change in the nature of the property due to the donation of land, then the County would take that into consideration during the property valuation process.
